In Ontario, a simple divorce is a divorce where the only thing you ask the court for is the divorce itself, with no court orders about property, support or parenting. It's usually filed by one spouse (a "simple application"), and the other spouse is served with the papers. If both spouses sign together, it's called a joint divorce.

People also use "simple divorce" to mean any straightforward, uncontested divorce in Ontario: one where you've already agreed on the big decisions. Either way, a judge usually grants it on paper, without a hearing.

  • either of you has lived in Ontario for at least one year immediately before filing;
  • you have no unresolved disputes about property, parenting or support; and
  • if you have children, reasonable child support arrangements are in place.
